Valhalla, New York (2006-11-13) As part of its continuing commitment to achieve the highest level of safety and health for its construction workers, Cappelli Enterprises today signed a comprehensive safety construction agreement with the U.S. Occupational Safety & Health Administration (OSHA). The contractor/government partnership covers construction work that will get underway on the second tower of the Renaissance Square complex in downtown White Plains.

The extensive scope of the agreement, which has not been widely used in Westchester, was signed between Cappelli Enterprises and its general contractor subsidiary, George A. Fuller Co., Inc. (GAFCO) and OSHA the New State Department of Labor On-Site Consultation Program; the Building and Construction Trades Council of Westchester and Putnam Counties and the Construction Industry Council of Westchester and Hudson Valley. The agreement took effect today at a signing ceremony held at The Residences at The Ritz-Carlton, Westchester Sales Presentation Center, White Plains.

The signatories included Louis R. Cappelli, President, Cappelli Enterprises; Peter Palazzo, President and Paul H. Slaney, Chief Operating Officer of GAFCO; Patricia Clark, Region 2 Regional Administrator and Diana Cortez, Area Director, Tarrytown Area Office of OSHA Ed Doyle, President, the Building and Construction Trades Council; Ross Pepe, President, Construction Industry Council and James Rush, Program Manager, New York State Department of Labor.

Cappelli Enterprises is developing the $400 million, 940,000 square-foot Renaissance Square complex. Construction of the complex first tower ¯The Residences at The Ritz-Carlton, Westchester ¯is expected to be completed by September 2007.

GAFCO initiated discussions with OSHA in July 2006 to develop a safety program for work on the complex second tower. Louis Cappelli said, We are very pleased to be entering this innovative safety program. Construction safety has always been a top priority at our Company and this agreement gives us the opportunity to work with OSHA to track and compare our performance to assure that we rank among the safest in the industry.

Cappelli noted that the agreement does not mean that Cappelli Enterprises will approach safety standards any differently than what it has long practiced on all of its construction projects. We will continue to exceed OSHA's standards across a broad range of performance categories. We are going to share our data with OSHA such as time lost due to worker injuries as part of OSHA's ongoing mission to encourage more participation in the safety and health process from the construction/trades industry and to better utilize its resources.

He added, We take great pride in the exemplary safety and health programs on all of our projects. As a result, we have very low incidence of serious injuries to the workers and a high degree of productivity.¯

Ms. Clark, OSHA's Regional Administrator, stated: This partnership is an example of Secretary of Labor Elaine L. Chao's commitment to improving the health and safety of workers through cooperative partnerships with groups including employers, labor associations and trade organizations.

It is anticipated that on the second tower, GAFCO and its more than 20 subcontractors will each employ between 10 and 40 workers. Palazzo, GAFCO's President, noted that some of those workers are dedicated solely to providing safety-related tasks such as carpenters installing safety railings.

As in other Cappelli projects, GAFCO will assign a full-time safety manager to the Renaissance Square second tower job site to ensure compliance with construction, environmental, health and safety practices. GAFCO will track all worker injuries and illnesses and will provide detailed data to OSHA on a monthly basis. That data will enable OSHA to do a comparative analysis of GAFCO with national data.
